I am in medical malpractice colony negotiations with a dentist. Her insurance company was handling the negotiations, then the dentist license expired and the insurance company dropped the dentist. Is it possible that the original insurance company wants me to file clothing against the dentist, and then the new insurance company will have to defend the dentist? Or, because

The insurance company probably did await that you'd just go away. You aren't going to be able to fight this on your own, unfortunately. It's cruel to say, without specialized knowledge of the laws in your area, to know who is responsible--the dentist, the old insurance company, or the new insurance company. Find a malpractice attorney who will effort on contingency--don't

Answer: Tort rehabilitation is desperately needed. While it isn't a good idea to make doctors and other medical facilities safe from all lawsuits, there needs to be a cap on punitive damages, and a higher standard for fault to be found. As it is now, doctors also actually defensive medicine, which means they order more tests than may be necessary, just to duvet their a**es in case they do get sued.
